Parties:

Community: Hümanette, located at 118 W. 63rd Street, Kansas City, Missouri 64113, represented by its website www.humanette.co.

Member: All current and future Hümanette Monthly Play Members.

​

Acceptance:

By using www.humanette.co or selecting "I Accept" during registration, you agree to the terms of this Agreement.

​

1. Nature of Service:

Hümanette offers an indoor play space with benefits including:

• Unlimited open play.

• Unlimited drip coffee.

• 10% off events, cafe purchases, & select retail items.

  • ​Individuals must have current memberships at the time of the event in order to receive discount.

• 1 free chatbooth reservation monthly.

2. Registration and Information:

Members must accurately complete the New Member form and update information as needed.
Membership activation requires an in-person visit to Hümanette.

​

3. Recurring Payment:

Monthly Membership plans shall automatically renew on a monthly basis commencing from the date of membership activation. Payment for the renewal shall be processed utilizing the credit card on file.

​

4. Release Clause:

Members release Hümanette from liabilities in disputes with other Members.

​

5. Privacy Policy:

Member's personal information is not sold or rented without explicit consent.
Information is stored on secure servers in the United States.

​

6. Indemnity:

Members indemnify Hümanette against claims due to Agreement breaches or legal violations. Additionally, members acknowledge and agree that Hümanette shall be protected under this Agreement from any claims, liabilities, or damages arising out of their use of Hümanette's services or facilities.

7. No Agency Relationship:

This Agreement does not create any agency, partnership, joint venture, or employment relationship.

​

8. Membership Cancellation:

Monthly memberships have a three-month minimum term.

After three months, cancellation requires a 14-day notice before the next billing date; fees are not pro-rated.
Cancel via email at hello@humanette.co subject: Membership Cancellation or by calling 816-710-9693 and speaking with a manager or owner.

9. Membership Suspension

Members have the option to suspend or pause their membership for up to 60 days once per calendar year. During this suspension period, membership benefits will be temporarily unavailable, and no membership fees will be charged. At the end of the 60-day period, the membership will automatically reactivate and billing will resume unless the member cancels their membership according to the Membership Cancellation policy (section 8).  

To request a suspension, members must notify Hümanette via email at hello@humanette.co with the subject line "Membership Suspension Request" at least 7 days before the desired start date of the suspension.

10. Amendment and Modification:

Hümanette reserves the right to amend, modify, or update other elements of this Membership Agreement at any time. Any changes will be effective immediately upon posting on the Hümanette website or notification via email to members. Continued use of Hümanette's services after the posting of any amendments constitutes acceptance of those changes by the member. If a member does not agree with the amended terms, they must notify Hümanette and may terminate their membership in accordance with the Membership Cancellation policy outlined in this Agreement.

11. Governing Law:

This Agreement is governed by Missouri law. Additionally, members acknowledge and agree that any disputes or claims against Hümanette shall be subject to the exclusive jurisdiction and venue of the courts located in Missouri.

12. Arbitration:

Disputes resolved under the American Arbitration Association's commercial rules. Additionally, members acknowledge and agree that any arbitration proceedings initiated by or against Hümanette shall be conducted in Missouri.

13. Photo Release:

By becoming a member of Hümanette, you grant Hümanette LLC and its affiliates the right to use photographs or videos taken of you and/or your child(ren) during your visit to Hümanette's premises, events, or activities for promotional purposes. You understand and agree that these images may be used in print materials, digital media, broadcast media, and public relations activities without further approval or compensation. If you do not wish to grant Hümanette these rights, please inform a staff member before any photographs or videos are taken.

14. Compliance with Policies and Membership Termination:

Members are required to strictly adhere to all of Hümanette's policies and follow staff instructions at all times. It is imperative that members conduct themselves in accordance with the rules and guidelines established by Hümanette to ensure a safe and enjoyable environment for all.

Furthermore, members explicitly acknowledge and agree that any breach or violation of Hümanette's policies or staff instructions may lead to immediate termination of membership without refund. Such termination may occur at the sole discretion of Hümanette management, based on the severity and nature of the violation.

Grounds for membership termination may include, but are not limited to:

1. Children or adults engaging in behavior that poses a threat to the safety or well-being of other members, staff, or guests.

2. Disruptive conduct that interferes with the peaceful enjoyment of Hümanette's facilities by others.

3. Failure to comply with Hümanette's health and safety protocols, including but not limited to:

   • Wearing shoes in the play spaces​

   • Running in the play spaces

   • Throwing toys or other items or otherwise misusing the materials, furniture, and other supplies in an inappropriate, unsafe, or destructive manner

   • Knowingly bringing a sick child to play

4. Violation of any local, state, or federal laws while on Hümanette premises.

5. Any form of harassment, discrimination, or inappropriate behavior towards other members, staff, or guests.

6. Damage to Hümanette property or facilities caused by deliberate or negligent actions.

7. Repeated violations of Hümanette's policies despite warnings or corrective measures.

It is the responsibility of each member to familiarize themselves with Hümanette's policies and guidelines and to conduct themselves accordingly. Failure to do so may result in immediate termination of membership privileges, at the discretion of Hümanette management, without any entitlement to refund or compensation.
